Loss of inheritance rights
It is important to know that spouses lose their reciprocal inheritance rights only in consequence of divorce.
Instead, couples who are legally separated still inherit from each other unless, when the required conditions are fulfilled, their separation is granted with the attribution of fault (a ruling that the Court may hand down only at the specific request of the injured party, who must prove in court that their spouse repeatedly failed in their duty to be faithful, to live under the same roof, provide moral and material support and collaborate in pursuit of the family’s best interests).
