The damages that a victim can recover
A victim of medical malpractice can obtain compensation for:
- the pecuniary damages resulting from being unable to work (loss of income caused by the injury);
- the medical expenses incurred in minimizing or rectifying the damage caused;
- the personal injury suffered (in terms of the degree of both temporary and permanent physical and/or psychological impairment, according to the nationwide tables applied at the time);
- non-pecuniary damages (including for pain and suffering, loss of consortium/social life and also the inability to engage in activities habitually carried out previously; these damages are usually calculated at a percentage of the personal injury damages awarded);
- the loss of opportunities.
