Introduction
It is important to know that the lawyer who assists in such a traumatic stage of the existence of a family as a separation is unlike any other type of legal figure.
While the work of the lawyer generally provides to safeguard the rights of one party against the other, in a view of inevitable opposition, in the case of a procedure for separation (or divorce) a good lawyer’s first priority is to ensure the rights of the family as a whole and, only within that framework of the delicate, residual balance of the (former) family, to work for the client’s defense.
This is the meaning given by the legal profession on the subject of procedures for separation and divorce, which should never be reduced to sterile warfare, but should be instruments for the construction of a new and better future for all the members of the family. This is the purpose, once again, of the most recent legislation on the subject of joint custody.
This principle has great value when the family includes children, in relation to whom, in the absence of the firm, mediating and knowledgeable hand of a qualified lawyer – the more litigious couples, in the exasperation of the conflict, risk losing sight of the grievous suffering they can undergo.
It is therefore absolutely advisable for responsible people to choose a specialized lawyer who will keep these priorities of family law clearly in the forefront.
An unspecialized lawyer, or one who, in any case, handles the separation procedure in an exclusively view of conflict, is not giving the client or the client’s family good service.
Stressing the marginal aspects of conflict when, in the circumstances, agreement is – theoretically – within hand’s reach, means, in addition to lowering the quality of life of the clients, exposing them to useless costs and probably to worse results.
